These Terms of Service (the “Terms”) govern your access to and use of the Benchlytics website, applications and analytics services (collectively, the “Service”) operated by Benchlytics LLC (“Benchlytics,” “we,” “us” or “our”). By creating an account, starting a free trial or using the Service, you agree to these Terms.
1. What Benchlytics is (and is not)
Benchlytics is an informational sports-analytics platform. We provide data, statistical projections, lineup optimization tools and start/sit research intended to support your own fantasy sports decisions. The Service is offered for informational and entertainment purposes only.
Benchlytics is not a sportsbook, betting service, casino or daily-fantasy-contest operator. We do not accept wagers, host contests, hold customer funds or award prizes, and we are not affiliated with any sportsbook or daily-fantasy operator. Projections are estimates only; we do not guarantee any particular result, outcome or level of accuracy.
2. Eligibility
You must be at least the age of majority in your jurisdiction (and at least 18 years old) to use the Service. You are responsible for ensuring that your use of the Service complies with all laws that apply to you. Where applicable, please play responsibly (21+).
3. Accounts
You agree to provide accurate information when creating an account and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at contact@benchlytics.com if you suspect unauthorized use.
4. Subscriptions, free trial and billing
The Service is offered on a subscription basis with monthly and annual plans. New subscriptions include a 7-day free trial. Payment is processed by our third-party payment processor, Stripe; by subscribing you also agree to Stripe’s applicable terms.
- Free trial. You will not be charged during the 7-day free trial. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged the then-current plan price.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel.
- Price changes. We may change subscription prices; any change will apply to billing periods after we provide notice.
5. Cancellation and refunds
You may cancel at any time through your account’s billing portal. If you cancel during the free trial, you will not be charged. If you cancel a paid subscription, the cancellation takes effect at the end of your current billing period and you retain access until then.
No-refund policy. Except where required by applicable law, subscription fees are non-refundable once the free trial has ended and a billing period has begun. We do not provide refunds or credits for partial billing periods, unused time or features you did not use.
6. Acceptable use
You agree not to misuse the Service, including by scraping or redistributing our data at scale, reverse-engineering the Service, reselling access, or using the Service for any unlawful purpose. We may suspend or terminate access for conduct that violates these Terms.
7. Intellectual property
The Service, including its projections, software, design and content, is owned by Benchlytics LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial fantasy research.
8. Disclaimers
The Service and all projections are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that projections will be accurate, complete or lead to any particular result. Sports outcomes are inherently uncertain, and you use our analytics at your own discretion.
9. Limitation of liability
To the maximum extent permitted by law, Benchlytics LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on projections or use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the twelve months preceding the claim.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
